Candidate / Talent Pool Terms & Conditions

- IntroductionThese Terms & Conditions (“Terms”) govern your registration, access to, and use of the talent pool and candidate services provided by Neurone Recruitment Pty Ltd (“we / us / our”), including the collection, storage, and processing of your Personal Information.By registering, submitting information, uploading documents, or otherwise using our candidate portal (“Platform”), you agree to be bound by these Terms. If you do not agree with these Terms, you must not register or use the Platform.
- Definitions
- Candidate means a person who registers on the Platform and submits personal and professional information.
- Client means an employer or organisation seeking to engage candidates through our recruitment services.
- Introduction means the provision of a Candidate’s details (including CV, profile, or verbal identification) to a Client for potential employment purposes.
- Personal Information has the meaning given in the Privacy Act 1988 (Cth).
- Placement means engagement of a Candidate by a Client in any capacity (permanent, temporary, casual, contract, or otherwise).
- Platform means our website, candidate portal, database systems, and associated technology used to manage talent pooling and recruitment activities.
- Eligibility and Registration
- You must:
- Be at least 18 years of age; and
- Be legally entitled to work in Australia at the time of registration or clearly disclose your visa status.
- You warrant that all information provided is accurate, complete, and not misleading.
- You agree to promptly update your profile if:
- Your employment status changes
- Your visa status changes
- Your contact details change
- You no longer wish to be considered for opportunities
- You are responsible for maintaining the confidentiality of your login credentials.
- You must:
- Nature of Our Recruitment Services
- We act as an independent recruitment intermediary between Candidates and Clients.
- Registration in our talent pool:
- Does not create an employment relationship between you and us;
- Does not guarantee interviews, job offers, or placements;
- Does not create any partnership, agency, or joint venture relationship.
- We do not charge Candidates a fee for recruitment services in accordance with the Employment Agents Act 1976 (WA), where applicable.
- Any recruitment fee arrangements exist solely between us and our Clients and do not create any payment obligation for Candidates.
- Consent to Collection, Use and Disclosure
- By registering, you expressly consent to us:
- Collecting and storing your Personal Information;
- Assessing your suitability for employment opportunities;
- Conducting reference checks (with prior notice where required);
- Verifying employment history and qualifications where necessary;
- Disclosing your Personal Information to Clients for potential employment opportunities;
- Disclosing your information to third-party service providers assisting our recruitment operations.
- You acknowledge that some Clients or service providers may be located outside Australia, and you consent to overseas disclosure where reasonably necessary.
- You may withdraw consent at any time by written request, subject to legal or contractual retention requirements.
- By registering, you expressly consent to us:
- Data Retention and Talent Pool Validity
- We will retain your Personal Information only for as long as reasonably necessary for recruitment purposes and in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
- Unless you request earlier removal, your profile may remain in our talent pool for up to five (5) years from the date of your last meaningful interaction with us, after which it may be archived or securely deleted.
- “Meaningful interaction” includes:
- Applying for a role
- Updating your profile
- Responding to communications
- Participating in interviews arranged by us
- We may contact you periodically to confirm whether you wish to remain in our talent pool.
- You may request removal from our database at any time by contacting us in writing.
- No Guarantee of Placement
- We do not guarantee:
- Interviews
- Employment offers
- Visa sponsorship
- Any specific timeframe for placement
- Hiring decisions are made solely by Clients.
- We are not responsible for any decision made by a Client in relation to your candidacy.
- We do not guarantee:
- Separation from Paid Career Services
- Registration in our talent pool relates solely to recruitment representation services.
- If we offer separate paid career coaching or advisory services (e.g. Professional Development Program – PDP, or Australian Career Explorer – ACE), those services:
- Are governed by a separate written agreement;
- Are entirely optional;
- Do not improve or prioritise your chances of recruitment placement.
- Participation in paid services does not guarantee employment outcomes.
- Use of Uploaded Documents
- You warrant that:
- You own or have the right to provide all uploaded Documents;
- They do not infringe any third-party rights.
- You grant us a non-exclusive licence to use, reproduce, and disclose your Documents solely for recruitment and placement purposes.
- You warrant that:
- Candidate ObligationsYou agree to:
- Provide truthful and complete information.
- Act professionally in communications.
- Notify us of changes to employment status.
- Conduct yourself professionally in dealings with Clients.
- Limitation of LiabilityTo the maximum extent permitted by law:
- We are not liable for any indirect or consequential loss arising from your use of the Platform;
- We are not responsible for workplace conditions, employment terms, or actions of Clients;
- Nothing in these Terms excludes rights under the Fair Work Act 2009 (Cth) or Australian Consumer Law where applicable.
- Compliance with Applicable Law
- These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
- Our recruitment services operate in accordance with:
- The Privacy Act 1988 (Cth);
- The Employment Agents Act 1976 (WA), where applicable;
- Relevant Australian employment legislation.
- Compliance with legislation does not guarantee employment outcomes.
- AmendmentsWe may amend these Terms from time to time. Updated Terms will be published on the Platform with a revised effective date.Continued use of the Platform constitutes acceptance of the updated Terms.
